This User Agreement (the “Agreement”) governs the use of the visa-vis mobile application for iOS and its web version, provided as a PWA (together, the “App” or the “Service”).
Rightsholder and operator of the Service: Aleksei Sinkov
Email: ao.sinkov@gmail.com
App identifier: app.visavis.ios
By installing, launching, or using the App, the User confirms that they have read this Agreement and accept its terms.
1. Definitions
User — a natural person using the App.
Service — the visa-vis mobile application for iOS and its web version (PWA), which provide the User with tools for the local tracking of trips, passports, visas, stamps, tickets, and related data.
User Data — information that the User independently enters, imports, scans, or otherwise saves in the App.
Reference Data — information about visa rules, permitted length of stay, visa regimes, passport requirements, and other restrictions, whether built into the App or downloaded separately.
2. Subject of the Agreement
2.1. The Service provides the User with information and reference services for independently tracking trip history and working with information about passports, visas, permitted length of stay, and tickets.
2.2. The Service is designed for the convenient storage, structuring, and calculation of information and is not a government information resource, travel agency, immigration authority, consulate, law firm, or other official body that makes decisions regarding entry, exit, visa issuance, or permission to stay.
2.3. The Service does not issue visas, entry permits, or stay permits, and does not make decisions regarding the ability to cross any state border.
2.4. Use of the Service does not replace the User’s independent verification of the requirements of the relevant government authorities, border services, consulates, embassies, airlines, and other competent organizations.
3. Features of the Service
Depending on the version of the App used, the User may have access to the following features:
3.1. Passports and trips
The User may:
- store data for up to two passports;
- enter name, citizenship, country of residence, and passport issue/expiry dates;
- add trips and entry/exit records;
- enter country, city, mode of transport, border crossing point, notes, and intermediate stops;
- bulk-import stamps;
- mark open (ongoing) trips;
- receive a warning about an upcoming passport expiry.
3.2. Visas and stay limits
The User may:
- create records for their own visas;
- use built-in visa-regime templates or create custom ones;
- enter visa validity period, number of entries, day limit, and the rolling window used for the calculation;
- calculate length of stay based on entered trips;
- use calculations related to rules such as 90/180;
- obtain a calculated recommended departure date;
- use a “what if?” calculator;
- receive warnings about a possible limit overstay;
- archive completed visas.
3.3. Map and statistics
The Service may display a schematic world map based on the User’s trip data and generate statistics, including number of countries, days of stay, and calculated distances.
The map is not a navigation system and does not use GPS or the User’s geolocation.
3.4. Tickets and boarding passes
The User may add ticket and boarding pass information:
- manually;
- from booking text;
- from Apple Wallet
.pkpassfiles; - by scanning a barcode with the camera;
- from a photo.
Where the necessary data is available, the User may create a trip record based on a flight.
3.5. Additional features
The Service may provide:
- interface language switching (available languages: English, Russian, Ukrainian, Turkish, Kazakh);
- calculation of days spent abroad (90 / 180 / per year / all-time, with a separate reference indicator at 183+ days);
- local achievements and badges;
- reference information on “passport strength”;
- export of trip history for the preparation of visa applications, including in formats aligned with common visa procedures (for example, Schengen, DS-160, UK) — subject to the limitations set out in Section 4 of this Agreement;
- backup of data via a self-initiated JSON export;
- import of previously exported data;
- clearing of trips, visas, and tickets. Such clearing does not affect the User’s profile and passport data unless the User separately deletes it by other means;
- demo data.
Demo data is used solely to familiarize the User with the interface, is overlaid on top of the User’s data for preview purposes, and does not modify or overwrite data entered by the User.
3.6. Reference catalogs (optional)
By default, the App includes a built-in set of stay rules sufficient for tracking trips, stamps, visas, and tickets without an internet connection.
Additionally, where an internet connection is available, the User may optionally download:
- an extended catalog of visa rules;
- a slice of the visa-regime reference database limited to the passport(s) selected by the User.
Downloading additional reference catalogs is not required for the basic use of the Service. Without an internet connection, the Service relies on data previously saved on the device and on the built-in rules.
4. Informational Nature of the Service
4.1. All calculations, recommendations, dates, warnings, limits, and other information displayed by the Service are informational and for reference purposes only.
4.2. In particular, calculations of:
- length of stay;
- the permitted number of days;
- the recommended departure date;
- rules such as 90/180;
- the number of entries used;
- visa validity periods;
- other visa- and immigration-related restrictions
do not constitute legal advice, an official interpretation of the law, or a guarantee of the User’s right to enter, remain in, or leave any territory.
4.3. The User must not rely solely on the Service’s data or calculations when making decisions about travel, purchasing tickets, crossing a border, applying for a visa, extending a stay, or taking any other legally significant action.
4.4. Before travel and before crossing a border, the User independently verifies the current requirements against the official sources of the relevant state, including, where applicable:
- official government websites;
- consulates and embassies;
- border and immigration authorities;
- official visa application centers;
- the official requirements of the carrier.
4.5. Even where the Service contains a corresponding rule or calculation, the User must take into account the possible existence of additional conditions, exceptions, special regimes, and individual circumstances.
5. Currency and Completeness of Information
5.1. Visa, immigration, border, and other rules may change without prior notice.
5.2. Reference Data, whether built into the App or downloaded separately, may be:
- incomplete;
- inaccurate;
- outdated;
- inapplicable to the User’s specific situation;
- changed after the time of its publication or update.
5.3. The Service does not guarantee that the information it contains reflects, at any given moment, the latest changes in legislation or administrative practice.
5.4. Additional catalogs and updates referred to in Section 3.6 may be provided separately. The absence of an internet connection does not prevent the use of data already saved on the device; however, such data may also become outdated.
5.5. Where there is a conflict between the Service’s information and the official requirements of the relevant government authority, the User must follow the current official requirements.
6. User Responsibility
6.1. The User is solely responsible for the accuracy of the data they enter.
6.2. In particular, the User independently verifies:
- the accuracy of entry and exit dates;
- the accuracy of passport data;
- visa validity periods;
- the number of entries used;
- applicable stay limits;
- the availability of necessary permits;
- document requirements;
- the rules of the specific country and specific route.
6.3. An error in the source data may result in an incorrect calculation. The User understands and accepts this risk.
6.4. The User independently makes decisions regarding travel, crossing borders, submitting documents, and complying with visa and immigration requirements.
7. No Guarantee of Entry or Stay
7.1. Holding a valid visa, meeting a calculated limit within the Service, or receiving a positive calculation result does not guarantee admission to the territory of any state.
7.2. Decisions regarding entry, the permitted length of stay, passage through border control, and other related matters are made by the competent government authorities and/or the carrier in accordance with applicable rules.
7.3. The Service is not responsible for the decisions of government authorities, border services, consulates, carriers, or other third parties.
8. Data Storage
8.1. As a general rule, the App operates offline, and the User’s data is stored on the User’s own device.
8.2. Account registration is not required to use the Service’s core features.
8.3. The Service does not provide cloud synchronization of data between devices unless such a feature is expressly stated for the relevant version of the Service.
8.4. The Service does not use advertising trackers or analytics, unless otherwise expressly stated in the current Privacy Policy.
8.5. The User is solely responsible for the security of their device and for access to the data stored on it.
8.6. If the App is deleted, the device is reset or damaged, or other circumstances result in the loss of local data, recovery of that data may not be possible.
8.7. A backup may be created by the User via the export feature. The User is solely responsible for storing the exported file and protecting it from unauthorized access.
9. Device Permissions
For certain features, the Service may request operating-system permissions. This Section applies to the iOS version of the App.
9.1. Camera
The camera may be used to scan boarding-pass barcodes.
9.2. Calendar
Calendar access may be used to add events and reminders to the “visa-vis” calendar, if the User has enabled the corresponding feature.
9.3. Notifications
Notification permission may be used for local reminders.
9.4. Location
The Service does not request or use the User’s geolocation.
The User independently enters countries, cities, border crossing points, and other trip details.
10. Reminders
10.1. Where the corresponding feature is enabled, the Service may generate reminders, including about:
- an upcoming passport expiry;
- an upcoming visa expiry;
- the calculated recommended departure date;
- an upcoming flight.
10.2. The method of delivering reminders depends on the version of the Service used:
- in the iOS app — via local device notifications and/or events added to the “visa-vis” calendar;
-
in the web version — via a
.icsfile that the User can download and add to a calendar application of their choice.
10.3. Reminders are a supporting feature and do not guarantee timely delivery.
10.4. Delivery of a reminder may depend on device settings, the operating system, the calendar application used, power-saving modes, granted permissions, and other technical circumstances, including those beyond the Rightsholder’s control.
10.5. The User is not relieved of the obligation to independently monitor document expiry dates and legal requirements.
11. Intellectual Property
11.1. Exclusive rights to the App, its source code, design, interface, name, logos, graphic elements, texts, and other protectable elements belong to the Rightsholder or are used by the Rightsholder on a lawful basis.
11.2. The User is granted a limited, non-exclusive right to use the App solely for personal purposes in accordance with this Agreement.
11.3. Unless otherwise expressly permitted by law, the User may not:
- copy the App;
- distribute it;
- sell or lease it;
- modify it;
- decompile or reverse-engineer it;
- extract its source code;
- create derivative works based on it.
12. Changes to and Discontinuation of the Service
12.1. The Rightsholder may change the interface, functionality, reference data, and technical characteristics of the Service.
12.2. Individual features may be added, changed, temporarily unavailable, or discontinued.
12.3. The Rightsholder may discontinue support for particular versions of the App, including in connection with changes to operating systems or technical infrastructure.
12.4. If discontinuation of the Service makes local data unusable, the User is advised to create a backup in advance using the available export feature.
13. Limitation of Liability
13.1. The Service is provided for informational and reference use.
13.2. To the extent permitted by applicable law, the Rightsholder does not guarantee:
- the absolute accuracy of calculations;
- the completeness of visa and immigration rules;
- the currency of all reference data;
- the absence of errors in the App;
- uninterrupted operation of all features;
- that calculations correspond to the User’s specific individual situation;
- that a government authority or carrier will make a favorable decision.
13.3. To the extent permitted by applicable law, the Rightsholder is not liable for the consequences of decisions made by the User based solely on information from the Service.
13.4. In particular, the Rightsholder is not liable for denial of entry, refusal to issue a visa, violation of immigration status, overstaying a permitted period, changes in a state’s requirements, cancellation or change of a flight, actions of a carrier, or decisions of government authorities.
13.5. Nothing in this Agreement limits the Rightsholder’s liability to the extent such limitation is prohibited by applicable law.
14. Third-Party Services and Sources
14.1. Certain features may rely on data, formats, or technologies provided by third parties.
14.2. The Service may display reference information obtained from external sources. The presence of such information in the App does not mean it has been officially confirmed by the relevant government authority.
14.3. The User independently verifies, against an official source, any information that is material to them.
14.4. The additional reference catalogs referred to in Section 3.6 may be compiled from open and/or aggregated third-party sources of visa-requirement data. The inclusion of such data in the App does not mean it has been verified, confirmed, or endorsed by the relevant government authorities or by the third-party owners of the underlying sources.
15. Privacy
15.1. The processing of personal data and other privacy matters are governed by a separate Privacy Policy, which forms part of the rules for using the Service.
15.2. Because the App’s core data is stored locally, the User should be aware that anyone who gains access to an unlocked device or an exported backup file may potentially gain access to the information it contains.
15.3. The User is solely responsible for using device lock features, creating backups, and securing exported files.
16. Age and Legal Capacity
16.1. The User confirms that they have the legal capacity to enter into this Agreement under applicable law.
16.2. Where use of the Service by a minor is permitted by law, such use must take place with the necessary consent of a parent or legal guardian.
17. Acceptance of the Agreement
17.1. Installing, launching, or using the App means that the User has read this Agreement and accepts its terms, to the extent such acceptance is permitted under applicable law.
17.2. If the User does not agree to the terms of this Agreement, the User must stop using the Service.
18. Changes to the Agreement
18.1. The Rightsholder may amend this Agreement.
18.2. A new version will be published in the App, on the website, or by other available means.
18.3. Continued use of the Service after a new version takes effect constitutes acceptance of the amended terms, unless otherwise provided by applicable law.
19. Special Terms for Users of the App Store Version (Apple)
If the App was obtained by the User through the App Store, the following terms apply to the relationship between the User and the Rightsholder, in addition to the other provisions of this Agreement.
19.1. This Agreement is concluded solely between the User and the Rightsholder. Apple Inc. and its subsidiaries (“Apple”) are not a party to this Agreement.
19.2. Apple has no obligation whatsoever to furnish any maintenance or support services for the App. Any such obligations, to the extent applicable, are borne solely by the Rightsholder in accordance with this Agreement and applicable law.
19.3. In the event of any failure of the App to conform to an applicable warranty, the User may notify Apple, and Apple may refund the purchase price for the App to the User, if any was paid. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
19.4. Apple is not responsible for addressing any claims of the User or of any third party relating to the App or the User’s possession and/or use of it, including claims relating to:
- the App’s compliance with applicable legal or regulatory requirements;
- consumer protection;
- infringement of any third party’s intellectual property rights;
- any other claim arising from use of the App.
19.5. In the event of any third-party claim that the App infringes that third party’s intellectual property rights, the Rightsholder, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim, to the extent required by this Agreement and applicable law.
19.6. The User agrees to comply with applicable third-party terms when using the App, including the App Store Terms of Service, and represents that they are not located in a country subject to a U.S. Government embargo or listed on any U.S. Government list of prohibited or restricted parties.
19.7. Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement as it relates to the User’s use of the App obtained through the App Store, and Apple will have the right to enforce this Agreement against the User as a third-party beneficiary.
20. Governing Law and Disputes
20.1. This Agreement is governed by the laws of [insert jurisdiction], except where mandatory provisions of law applicable to the User provide otherwise.
20.2. Disputes are resolved in accordance with applicable law.
20.3. If any individual provision of this Agreement is found to be invalid or unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law.
